A disability certificate after amputation. What it really gives you and what it does not

After an amputation everyone repeats the same sentence: apply for a certificate. Nobody tells you that the amputation itself does not decide the degree, and that half of the entitlements only work once you ask for them separately.

Disclaimer: I write this as a person after an amputation who has been through these procedures, not as a lawyer. The text is informational and is not legal advice. Amounts and rules are given as of July 2026. Before you file anything, check the current state of play on official websites or talk to a social worker at your powiatowe centrum pomocy rodzinie, the district family support centre.

What follows is what I did not know at the start. A few of these things cost me months of wasted time, and two of them cost me money.

The degree does not follow from the amputation

The panel does not assess what is missing. It assesses how you function. The same above-knee amputation produces different certificates in two different people, and that is not a fault in the system, it is its premise.

The application carries the symbol 05-R, meaning impairment of the locomotor system. What counts is documentation showing the course of treatment, not the fact of the operation. A hospital discharge summary is not enough. Add your rehabilitation records, the history of complications in the residual limb, consultations at a pain clinic if you have them.

A small thing that is easy to trip over: the medical certificate written on the panel's own form is valid for three months from the date of issue. Until June 2025 it was 30 days, and plenty of websites still quote the old number.

If you are being treated for phantom limb pain, add the records from that clinic. The assessment covers everyday functioning, and chronic pain is part of it, but it has to be visible on paper.

The certificate may come out lower than you expect. I know of no public statistics on this, so I will not give you numbers, but the fact of an amputation does not guarantee the significant degree.

Four health entitlements at the significant degree

Since July 2018 there has been a separate act on special arrangements supporting people with a significant degree of disability. Several things that matter most to us come from it.

Medical devices without regard to replacement intervals. In practice you do not have to wait out the standard period before you can get a new prescription. Medical indications decide. The funding limit does not change, so you will still pay the difference, but the clock stops being an argument against you. You attach the certificate to the prescription and take both documents to your NFZ regional branch.

Outpatient specialist care without a referral. You do not have to collect a slip of paper from your family doctor before booking with an orthopaedic surgeon or a pain clinic.

Services out of turn. Out of turn does not mean on the spot. It means the provider sees you on the day you present yourself, and if that is impossible, sets a date outside the waiting list. You have to invoke it at the reception desk and have the certificate with you.

No funding cap on therapeutic rehabilitation. The provider will not send you away until next year because its NFZ contract is used up. Careful, this is not the same as needing no referral. A referral to a rehabilitation clinic or for a course of treatment is still required, and so is the limit on treatment days per referral.

Money and the traps in combining it

Zasiłek pielęgnacyjny, the care allowance, is paid by the municipality. It is 215.84 zł a month and the amount has not changed since 2019. It is not due if you are staying in an institution providing round-the-clock maintenance.

Dodatek pielęgnacyjny, the care supplement from ZUS, the social insurance institution, goes to people found incapable of independent existence and, automatically, to anyone drawing a pension after the age of 75. It is indexed every year and in 2026 it is 366.68 zł. You do not combine these two. If you receive the supplement, the right to the allowance expires.

Świadczenie wspierające, the supporting benefit, is an entirely separate route and the most worthwhile of the three. It does not depend on income, it is free of tax and it cannot be seized by a bailiff. The condition is at least 70 points in a decision of the wojewódzki zespół, the regional panel, on the level of need for support. Since January 2026 the full scale from 70 to 100 points has been in operation. The amount is a percentage of the social pension, so from March 2026 it falls between 792 and 4,353 zł a month.

The route has two stages, and this is where people lose money. First the application on the level of need for support, to the regional panel. The decision becomes final fourteen days after service, unless you ask for it to be reconsidered. Only then do you apply to ZUS.

Three things about combining benefits, because this is where the mess is worst.

That is why in the application to ZUS you indicate the month from which you want the benefit granted. Sit down and do the arithmetic together before you send it.

And a correction to something I read online far too often. Since January 2024 the new carer's benefit is due to carers of people under 18. A carer of an adult after an amputation has, as a rule, no right to it, unless they kept it under the old rules.

The prosthesis, PFRON and tax

Applications to PFRON, the state fund for the rehabilitation of disabled people, do not go to PFRON. They go to the district family support centre or the city family support centre, and they are registered in System Obsługi Wsparcia, the support services system. Watch the address: on 15 June 2026 the system moved to the public administration domain and now runs at sow.pfron.gov.pl. Accounts and submitted applications were unaffected, but old bookmarks need updating.

The one that matters most to us is the Aktywny samorząd programme, Module I, Area C. Task 3 is help with buying a limb prosthesis using modern technical solutions. Task 4 is help with keeping a prosthesis you already have in working order. This is the only route to public funding for such equipment. Beyond it there is your own money and fundraising. Applications under Module I for 2026 are accepted until 31 August.

Funding towards rehabilitation stays, removal of barriers in the home and rehabilitation equipment runs separately. The amounts depend on the district, the programme and your income.

The rehabilitation relief in income tax has limits that summaries usually leave out. Use of a private car is a flat amount, at most 2,280 zł a year, and here you do not have to keep receipts for fuel or repairs. Medicines are deductible only above 100 zł a month and only on the recommendation of a specialist.

The most important rule concerns the prosthesis itself. Only expenditure that has not been compensated can be deducted. If part of it was covered by NFZ or PFRON, only your own contribution counts towards the relief. With a prosthesis costing tens of thousands of złotys this single rule decides the whole settlement, so keep every funding decision together with the invoices.

Going back to work

The significant and moderate degrees give the same working time norm: seven hours a day and thirty five a week. The norm applies from the day you present the certificate to your employer, not retrospectively. It does not reduce pay set at a fixed monthly rate. It is also rigid rather than an average: you cannot even it out with a longer week in exchange for a shorter one.

On top of that there is an extra fifteen minute break counted into working time, a ban on night work and overtime, and ten working days of additional leave. The leave is due after a year worked from the day you were assigned the degree, and it is not due to people who already have a right to leave longer than 26 days.

You can also take time off work for a rehabilitation stay or for specialist examinations, keeping your right to pay.

The parking card and travel

The parking card does not follow from the degree. It follows from point nine of the certificate, the indication of significantly limited ability to move about independently. Whether you get it is decided by the adjudicating panel. You cannot apply for it separately or in advance, because it is not a separate matter but a part of the certificate. If it is not in the certificate, you will not get the card even with the significant degree.

At the significant degree the cause symbol makes no difference. At the moderate degree the indication can go only to people with the symbol 04-O, 05-R, 07-S or 10-N. Ours is 05-R, so with a moderate certificate this route is still open.

You apply for the card itself once you have a legally valid certificate, at any district or city panel. You need a photograph 35 by 45 millimetres and a fee of 21 zł. The card is issued by the chair of the panel and is valid for up to five years. There is no appeal against a refusal to issue the card alone, because that is a technical act. You can appeal only against the certificate, to the regional panel, within 14 days of service.

Statutory travel discounts apply at the significant degree, on single tickets: 49 per cent on ordinary trains and on PKS coaches in ordinary service, 37 per cent on fast and express trains and on accelerated and fast coaches. The moderate and mild degrees give no right to the statutory discount. A separate rate of 95 per cent applies to a carer travelling with you.

Discounts on local public transport are a completely different matter. They are set by resolution of the municipal council and look different in every city, so check the rules of your own operator instead of assuming they will match the town next door.

Five things to start with

  1. Put together documentation from the whole course of treatment, not just the discharge summary. Clinic records, test results, the course of rehabilitation, pain treatment.
  2. Make sure your limitations in moving about are described in the documentation. That is what the adjudicating panel uses to decide point 9, and the parking card depends on it.
  3. In parallel, apply to the regional panel for the level of need for support. It is a separate route and separate money.
  4. Check the Aktywny samorząd deadlines at your own district centre. Module I closes on 31 August.
  5. Before you file your tax return, gather every funding decision in one place. Without them you cannot work out how much you are allowed to deduct.

Each of these benefits is granted on the application of the person concerned. There is no single office that will pull them together for you, which is why it pays to know in advance what goes where.
